incredible procedure that has given him new arms. but we begin with the weather whiplash. what a difference a day makes. freezing rain and sleet from a messy monday morning commute. temperatures topping the 70- degree mark. the wild weather is just getting started. thanks for joining us, everyone, i'm brian bolter. >> and i'm shawn yancy. we could see spring-like thunderstorms tomorrow. sue is outside the studios tonight with this weather alert. sue. >> hey shawn and brian. it's amazing i was out here friday evening measuring the snow and tonight it's warm enough to be without a coat on. it's because of the warmth, a 25 to 30-degree above normal temperature surge we had thanks to sunshine and that warm front getting further north. and yes, we are going to have another warm one tomorrow, but we do have to talk about the potential for thunderstorms. some of which could be heavy. we'll start with a look at those high temperatures today. we did not break any records because we do occasionally get warm in january.

today's record, 76, we got to 69. but dulles, 07 degrees. charlottesville was 74. fredericksburg was 74. a couple spots stayed colder, but i wanted to show you how warm it was. 77 in wilmington today. 72 in little rock. how about new orleans at 79. i bet they are glad the super bowl is this week and beyond that, you see a big dropoff in temperatures into the 30s. right where those two air masses are colliding, boy do we have a big line of thunderstorms. check this out. we measured this line at 1200 miles long, all the way from michigan down to east texas. it has produced a couple tornadoes, some gusty winds and heavy rain and yes, it is heading in our direction. so temperatures tomorrow definitely going to be mild, but you also need to take an umbrella. we'll have a mild night tonight. it looks like we'll be staying in the 50s. it's in the 50s now all over the region. so way above normal tonight. whether or not those storms are severe tomorrow depends on

whether or not we get sunshine. you should be thinking about the potential for afternoon rain and evening rain, and yes, a rumble of thunder. maybe with strong and gusty winds. get this. i've got snow on the seven-day forecast again. before the end of the week. so we have lots to talk about when i join you inside. it will take a while before i get in there. it is too nice to leave. >> we'll see you in a few. now to a news alert about two major court decisions. a judge decided the fate of the executive accused of misconduct in office. we begin now with a former culpeper, virginia, police officer found guilty of shooting an unarmed woman to death. fox 5's will thomas is in the newsroom with more. will. >> a former culpeper cop said he shot a woman in her car last year in self-defense, claiming she drove off and tried to kill him. a jury did not buy it. a guilty verdict will send him away to prison for a long time and give the victim's family and the community a starting

point to heal. it's the video we're used to seeing at his trial. former town of culpeper police officer, daniel harmon-wright, arriving at the courthouse, defending himself against murder allegations. here's the new video of the 33- year-old. cuffed, his bond revoked after a jury convicted him of voluntary manslaughter. >> the jury chose to come back with voluntary manslaughter. >> john hanrahan first announced the verdict on fox 5 news at 5:00. he was inside the courtroom when it happened. >> put his hands over his mouth for a good long period of time as the jury explained his verdict. his wife burst into tears as it was over. he never cried. he just looked profoundly unhappy. >> here's the back story. february 9, 2012, harmon-wright responded to a call about a suspicious person in a parking

lot. he encountered patricia cook. she accelerated, closed her window on his arm and dragged him. harmon-wright opened fire, shooting cook seven times. the jury didn't believe he was trying to protect himself or anyone else when he shot and killed her. the late patricia cook's brother, john wagler, is pleased with the outcome. >> it allows for healing. it allows for change. i don't want his life. >> harmon-wright was found guilty on two counts of firing into an occupied vehicle. the same jury will assemble tomorrow to come up with a sentence. he is facing up to 25 years in prison. any reaction from culpeper police officers? >> the mayor released a statement, i can paraphrase some of this. he said it's time to start the healing process and reminded all of us not to judge those hard working, culpeper police officers, both men and women,

based on the actions of just one person. >> all right, will thomas, thank you. an anne arundel county judge found john leapold guilty. he was on trial for using his security detail for personal and political purposes. the judge said he broke the law and abused his power by having his detail put up campaign signs, collect contributions, and have them empty hi catheter bag. he has been suspended from his job until the county council decides what's next. >> we obviously were disappointed in the court's verdict. it has been our position from the outset that the conduct complained of here represented poor judgment as opposed to criminal conduct. >> there is no word when he will be sentenced or if he plans to appeal. new clues tonight in a northeast nightclub shooting. a gunman opened fire on the crowd hitting five people.

police are asking for help from the public as they search for the suspect and two oths. lauren is live in the newsroom now with more. lauren. >> police are calling it an assault with intent to kill. the shooting happened just before closing time in the early morning hours on saturday when several strangers showed up at a party and a fight unfolded. >> people are alarmed, they are going like, hey, this doesn't happen here. >> the neighborhood on edge after five people were shot inside the d.c. sound stage along bening road over the weekend. >> it's tragic. >> police are looking for two person's of interest. they say the two young men pictured here walked into the nightclub along with the suspect uninvited during a private party. there was some sort of altercation with the people throwing the party and the person on the left was injured. >> his friends carried him out. and one of the people comes back with the silver gun and stands in the doorway and starts shooting into the crowd. >> four men and one woman ere

shot. >> when they left, all of them were in pretty good condition, two of them had been shot in the upper body and worried most about them, but i think everybody is going to be okay. >> samuel lived in an apartment above the venue. he describes a frightening scene. >> the shots and the panic of people running and screaming and hollering. >> police say it's a miracle no one was killed. >> a guy standing in the front of the club and starts shooting into a group of people. >> we are lucky five people are alive. despite the fact they are all injured. this could be a lot worse. >> on his website, the owner of the stage says the facility has been in business for two decades, hosting bands and comedians. >> it's more than a nightclub. it's a community club. he does everything in there. >> the advisory neighborhood commission holds meetings and holiday parties at the d.c. sound stage. over the phone, we are so

grateful no one died. we are praying for the victim's recovery and for the neighborhood as a whole. the police chief issued an emergency shutdown. the alcoholic beverage regulation administration will decide when and if the d.c. sound stage will reopen. the suspect was not caught on camera. he is described as a black male, 20 to 25 years old, 6 feet, 170-pounds, medium complexion with a full beard and dread locks. he used a silver gun, possibly a revolver. lauren, tonight. president obama dividing, diving into the new debate, throwing his support behind an backed by republicans and democrats. a white house plan. fox 5's tom fitzgerald has details. >> president obama headed west tuesday looking for cooperation and common ground on

immigration. in las vegas, the president threw his support between a new bipartisan senate effort to reform immigration and provide a path to citizenship for the 11 million people already here illegally. >> we can't allow immigration reform to get bogged down in an endless debate. >> mirroring the bipartisan senate proposal the president's plan creates a system for letting illegal immigrants earn citizenship, cracks down on businesses that hire illegals and heightens border security. >> we have to deal with the 11 million individuals who are here illegally. we all agree that these men and women should have to earn their way to citizenship. but for comprehensive immigration reform to work, it must be clear from the outset that there is a path way to citizenship. >> in hyattsville, maryland, immigration supporters gathered to watch the president's speech. inhale what had they called a realistic solution to a problem that has been long ignored.

>> we are extremely excited that there seems to be momentum and energy. >> while agreeing that immigration laws need to be fixed, virginia republican governor, bob mcdonald, told wtop that the president has been largely absent from the issue. >> i applaud them for getting together and getting something done. the president has done nothing but talk for four years about getting this done and offered nothing to move the ball down the road. >> but immigration analysts warn the political gains both parties are eyeing from pushing reform could also doom it if either side begins to see it as political costly. >> the republicans think they need to do immigration reform to try to get some hispanics back into the party, the democrats want to do it, too, because they promised immigration reform. >> the big unknown moving forward is how forces inside both parties will either speed up or slow down immigration reform. >> god bless the united states of america.

>> and we are beginning now to get a handle on the time line on all of this. senate officials say they expect to have the president's proposal and a senate plan handwritten out into legislation. which could be voted on as soon as early spring or summer. then the plan would move to the republican controlled house of representatives. in the newsroom, tom fitzgerald, fox 5 news. the next secretary of state. the senate voted this afternoon after the foreign relations committee gave their unanimous approval. kerry served on the committee for 28 years and he thanked the members and reminded them of the important work to come. >> this committee is critical to putting our best foot forward and helping us to hopefully make peace in places where it isn't and to advance our values and principles. what a privilege. >> kerry replaces hillary clinton, whose last day is friday. a national star pitcher

young man you are about to meet is the picture of determination. that, according to his doctors, make him the perfect patient. the woundened warrior was the recent recipient of a unique medical procedure. doctors gave him arms. fox 5's beth parker has the story. >> brandon lost all four limbs in an explosion in iraq that doctors in this room helped give two of those limbs back. >> i hated not having arms.

i was all right with not having legs. six weeks ago, brendan had a double arm transplant at johns hopkins. >> only six other patients had undergone successful double hand transplants in the u.s. i can rotate a little bit. >> 16 doctors in a host of others helped to connect the blood vessels, muscles, nerves and skin. he'll always remember the first time he moved his new arm. >> i was sitting there with my friends and did it by accident. one of my friends was just like freaking out. did you do that on purpose? i didn't know i was doing it. >> brendan's house is being cleaned up from the floods of hurricane sandy, but his dodge charger is still waiting for him. his proud mom looks forward to his homecoming. >> just surviving and moving forward. he shows the world you can do anything. >> brendan is leaving john hopkins today, but he still has a lot of recovering to do. the nerves in his arms will

regenerate about one inch per month. so it will be two or three years until he reaches his maximum mobility. >> i suspect that he will be using his hands for just about everything as soon as we let him start trying to do more and more. >> i just want to get the most out of these arms and just as goals come up, knock them down, and take it as absolutely as far as i can. >> along the way, he'll be thinking of the family of the unanimous donor. >> i'm humbled by their gift and they are certainly changing my life. thank you. >> he has a message for other wounded warriors. >> not give up hope. life always gets better when yow still alive. to be stubborn. there are a lot of people that will say you can't do something. be stubborn and do it anyway. >> in baltimore, beth parker, fox 5 news. >> a few more interesting facts about brendan. his surgery lasted 13 hours.

they rehearsed the procedure four times. brendan says once he is well enough, if he could shake hands with anybody, he would like to shake hands with country music star, blake shelton. several players purchasing performance enhancing drugs, including geo gonzalez. lindsey. >> gonzalez is denying these allegations, so are other players whose names appear on this list from an antiaging clinic in miami that dispensed performance enhancing drugs. this report claims that his name appeared on the handwritten note of the chief of the miami clinic. those records detail the selling of banned substances, geo's father denied his son's use of those substances and insisted his son had no contact and it was him who consulted with bosh to lose weight. major league baseball's department of investigations is looking into this matter,

gathering and reviewing information. he took to twitter today to proclaim his innocence saying i have never used performance enhancing drugs of any kind and i never will. i never met or spoken with tony bosh or used any substances by him. anything said to the contrary is a lie. nats general manager issued this statement in regards to the accusations. quote, this issue is currently being reviewed by major league baseball and it would be inappropriate for the nationals to comment until that review is completed. he is coming off his best season, having gone 21-8 with a 2.98 e.r.a. shawn, i saw him and spoke with him over the weekend and he has been working out and looking forward to the season. >> we are, too, thanks. we appreciate it, lindsey. the kennedy center made a huge announcement today. it's time to expand. the kennedy center opened 42 years ago. this will be the first expansion. the proposed $100 million

addition includes public spaces, a floating stage on the potomac river for outdoor performances and an outdoor video wall for performances. the project is expected to take five years, three for design, two for construction. officials plan to raise private funds. the chairman is giving you $50 million donation. a public meeting just wrapped up a couple hours ago in the district's one color design for taxi cabs. have a standard color theme. four options are being concerned. yellow the top choice followed by red. overhaul the city's taxi cab service. a scary accident this evening in maryland. a car slammed into a gnc store in germantown. we'll hear from an employee who saw it all happen coming up next.

scary moment at a german town nutrition store. a store employee who didn't want to be identified describes what happened. >> all of a sudden, an explosion. a big crashing sound. and then i saw the car inside the store and it was all the way in the store. i was like, oh my god. >> no one hurt. that employee tells fox 5 the woman in the suv got her foot caught under the accelerator. no word if she'll face charges. nine people were hurt in the pileup late this morning. happened just before noon. five of the injured were kids. we know two of the people who were hurt had serious injuries, but everyone is expected to survive. no word on the cause of that crash. tonight, three men under arrest for the murder of an elderly arlington man last fall. a family member found an 87- year-old dead inside his home in the 3700 block of north wake field street back in october.

police arrested his son, mackwood, jr., along with two others. they are all charged with first- degree murder. fairfax county police believe they caught the person who was skimming card numbers from atm machines. they say this man was caught on surveillance video when they arrested him, they say they found skimming equipment, is now charged with using the card at a number of nearby stores. he may not be the only person involved. police are still looking for other suspects. up next, back to one of tonight's big stories. will the bipartisan push for immigration reform fold under political pressure? our strategists go head to head. and cleaning up the debris three months to the day after superstorm sandy slammed into them. >> give us a call or send us an e-mail to fox5tips@wttg.com. we'll be right back. this is fox 5 news at 10:00. >> one of tonight's big stories, the time is now to deal with immigration reform. unveiled his new legislation during a speech in las vegas today. it includes more focus on law enforcement and updating the current system. the president says it's time to create a new path to u.s. citizenship. we have to deal with the 11 million individuals who are here illegally. we all agree that these men and women should have to earn their way to citizenship. but for comprehensive immigration form to work, it must be clear from the outset that there is a path way to citizenship. >> for more on this, we are joined by brenda daly and republican strategist, jordan lieberman. it seems like president obama is a day or two late on this. is he going to get the credit he is looking to get when congress, particularly the senate, came forward with a plan already? >> well, he will because

certainly the reason that they came out yesterday was because they knew that the president was making a speech in las vegas today. this is something that i am encouraged by the fact the senate had that yesterday. john mccain and marco rubio from the republican side and chuck schumer from the democratic side as well as others. i think there is a chance to do this. in the house, it will be a lot more difficult to get this through, but for once, you have political incentive from both parties to try and pass real immigration reform. >> jordan, we know the fly in the ointment is the republican controlled house. how is all of this going to fly by them? >> i think it's going to fly. listen, if you listen to what the democrats have to say about the republicans, there's going to be a bunch of red necks trying to round up these. that's not going to happen. all we are asking is, just sign the guest book on the way in, and republicans get it. they're not going to stand in the way. >> what about this long

standing belief that this is a free pass and encourages people to break the law that now that they are here, they will get citizenship. >> the president's plan does incentivize behavior, which is not what we want. >> i don't think that's right. the president endorsed the senate plan. what he said today, was that there has to be a pathway to citizenship. people who have been here legally have to learn english, they have to go through a background check. there's a number of steps that have to be done here. to me, during the republican primary campaign, you had the -- some of the contenders, in particular, mitt romney, talking about self-deportation. well obviously we saw what happened in the election. republicans realized they can't continue that rhetoric. there are some in the party that feel strongly about this. i hope it will pass the house. i don't think it will be easy to do in the house. i think it's going to be a difficult fight. >> i think the general public

is having whiplash here. nobody can get along or agree on anything up on capitol hill. suddenly, republicans are all for immigration reform and it looks like there's a path for it. and it happened overnight. >> it's going to pass the senate. i think the republicans and the house will come along. this is not necessarily what the house leadership built its agenda on. fiscal responsibility is really where their focus is. all this needs to do is a bunch of republican votes, as long as speaker boehner lets this come up for a vote. >> and the reason for that is politics. you look at the election and you know, hispanic vote 3-1 for president obama. and republicans, at least the smart ones, realize that long-term stainability, they can't continue their rhetoric that they had on this. there are some that will say that, but the smarter ones realize that's just not a sustainable path for the future. >> if anybody deserves credit, it's the latino voters that

d.c. police chief will be questioned in an investigation of the mass arrest in the district park more than ten years ago. testify in federal court about the arrest. protesters rounded up and detained. several claimed police tampered with evidence. missing computer documents and how she handled the case. there is no word on what happened to a new york woman who disappeared in turkey. police released video of suray eating at a food court. the mother of two had been in regular contact during the entire trip, but never made her trip home. her husband and brother arrived late monday to assist police. sierra traveled overseas after a friend canceled at the last minute. now take a look at this incredible video out of china, showing a sink hole swallowing an entire complex.

instead of focusing on his last hoorah, he is being talked about using banned substances. today, information from a sports illustrated article came out accusing lewis of trying to obtain a banned substance to speed the healing for a torn tricep. an injury that sidelined him for more than half of this season. he denied using substances when confronted and they backed him saying he never failed a drug test. here's what lewis had to say when asked by the media. >> that is a two-year-old story that you want me to refresh. i wouldn't give him the credit to even mention his name or his antics in my speeches or in my moment. i can't do it. i won't speak about it. i've been in this business 17 years and nobody has ever got up with me every morning and trained with me. every test i have ever taken in the nfl, there's never been a question if i have ever even

marriage. we wish them well. i guess if you like today, you'll love tomorrow. >> tomorrow will be different looking day. we had wall to wall sunshine. a few exceptions. tomorrow, i think we'll have clouds coming in and followed by rain. the timing of the rain is a little bit challenging. it will hold off until later. mostly after sunset. so, maybe coming through about this time tomorrow night as well. although we certainly can't rule out a few showers ahead of that. but whether or not it's going to be mild again tomorrow, yeah, we can say it will be. we'll be well above normal again. do we top the 730-degree mark, that depends when the clouds roll in. we did get warmer than we expected because it was sunnier than we expected as a frontal boundary changed its position a little bit. 70 degrees at dulles. not records as mentioned earlier, and it will be another mild day tomorrow. we'll say upper 60s.

if we get sunshine, we go above 70. if the clouds roll in earlier, we stay in the 60s. we do know this is different. showers and gusty thunderstorms rolling into the forecast, depending on when they get here. the later they get here, the less likely they are to pack a wallop. they are going to have heavy rain with them and you will notice the breezes picking up on wednesday afternoon as that front starts getting a little bit closer. that's because it has cold air behind it and that colder air will be noticeable as the front goes through and in place for the second half of this week. so a will lot of clouds. if we get sunny breaks, temperatures will respond to that. there's a lot of warm air available and down to our south today, we saw a lot of that. that's heading in our direction. we have thunderstorms, january thunderstorms in the forecast. we are even out look for the potential of some of those to be severe in an isolated way. the later they arrive, the less likely they are to be severe.

the breezes will pick up and on thursday, we drop to 46 degrees. so we're not going to be getting out of this all together. here's the setup. warmer air is moving through. we are outlooked by the storm prediction center. after the front moves through late tomorrow night, first part of thursday, we're chilly again and the sun is going to be back. no, one of our computer models is suggesting we may have another quick moving storm slipping through on friday morning bringing us a little bit more snow. so we also have to talk about that. but tonight, these temperatures are so mild. 53 degrees here in the district. 62 in fredericksburg w. you think about the fact that the average high should be 34 degrees. you get a sense of how much warmer we are. 57 in manassas. dulles is 58 degrees and still near 64 degrees in raleigh. still chilly up here in boston at 34. even boston gets in on the warmer air farm. here's a look at temperatures. south of the city, probably

closer to 70 or above it. again if you get more sunshine, we add more numbers to these digits. 64 for gaithersburg, 68 for d.c. we think some 50s out there again because those clouds will be rolling in. this is the system that we're going to be tracking coming in our direction. it is substantial. that is for sure. look at all the heavy rain and that squaw line right here with a moderate risk to strong to severe storms with a couple tornadoes reported. then just on the backside of it, there comes the snow. so we put it in motion and we got some clouds overnight. it is possible we could have some patchy fog as well as the atmosphere continues to moisten up. we think that will be mostly after sunset tomorrow, but some showers possible in the afternoon. if we get some rumbles of thunder, that would be later. and guess what? it's looking like this could have substantial rain with t. an inch to an inch and a half. especially right here along the

95 corridor and to the west. we'll watch for heavier rain tomorrow afternoon and tomorrow night as this system is moving on through. here's a look at the future cast. clouds around tomorrow morning, some sunny breaks as well. so enjoy that mild weather while you can. around 4:00 or so, our future cast is beginning to show the showers moving on in. some heavier downpours, but not a lot in the way of thunder. it would be closer to 11:00 when this is painted some thunder, potential rumbles of thunder. if that's the case, then maybe we don't have to worry about severe weather. the severe element gusty winds. we know there will be strong winds and thunderstorms would have the potential to bring those down to the surface. thursday morning clears out, should be sunshine. notice mountain snow and just for fun, wait until you see this. friday morning, this rpm model is trying to suggest snow or snow showers trying to rotate through the area. we'll see if that continues to show up. not every model is showing that

at this point. we'll keep an eye on friday morning forecast for you and see if we have anything else we need to pay attention to. so for tonight, 50. some clouds, maybe a few foggy spots. very mild for this time of year and another mild day tomorrow with cloud cover. showers around in the afternoon. maybe some evening or later nighttime thunderstorms with that temperature of 68. so yes start with the foggy spots and here's how we plan your day for you and we are expecting a temperature of 55 at 9:00 in the morning. 65 at noon. 66 at 4:00. maybe a shower or thunderstorm at that point. here's your fox 5 seven-day forecast. one more mild day and then we're back to reality with back to back holidays. ground hog day saturday, temperature of 38 degrees and super bowl sunday at 43 degrees. so that means it will be nice for staying inside. those temperatures are much more typical of this time of year. >> it will be weird. i'm used to here to talk
